1. Acceptance of Terms

By accessing or using the Run Speed Performance ("RSP") website at runspeedperformance.com, creating an account, participating in any RSP training program, attending any RSP event or session (on-site or off-site), or engaging RSP services through any channel, you agree to be bound by these Terms and Conditions. RSP is operated by JJ Ultimate Sports Training LLC, a Texas limited liability company. If you do not agree to these terms, do not use our services.

For users under 18 years of age, a parent or legal guardian must review and agree to these terms on the minor's behalf. By creating a parent account, signing a waiver, or enrolling a minor in any RSP program, the parent or guardian acknowledges acceptance of these terms for both themselves and their child.

2. Accounts & Eligibility

  • Platform accounts are available to users age 13 and older. Athletes under 13 participate in in-person training only and do not have platform accounts.
  • Athletes ages 13–17 must have a parent or guardian account linked to their profile. Parents maintain oversight through the Parent Portal.
  • Recruiting Network eligibility requires athletes to be 14 years or older. Athletes under 14 are not visible to college coaches or recruiters under any circumstances.
  • In-person training is available to athletes ages 6 and older with signed parental consent. Athletes ages 6–12 are served exclusively through in-person programs and do not receive platform accounts.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You agree to provide accurate, current, and complete information during registration and to update your information as needed.
  • RSP reserves the right to suspend or terminate accounts that violate these terms, engage in inappropriate conduct, or pose a safety risk to other athletes or staff.

3. Training Services

RSP provides youth speed training, performance coaching, and related athletic development services both in-person and through our digital platform. Our in-person services include but are not limited to:

  • Group speed training classes (Junior Speed Stars, Youth Speed Academy, Performance Prep, RSP Academy)
  • Private one-on-one coaching sessions
  • Small-group training sessions (2–4 athletes)
  • Speed and agility combines
  • Sports performance camps
  • Initial speed performance evaluations and assessments
  • Outdoor track sessions, park training, and field work

Assumption of Risk

By participating in any RSP training activity, whether at our facility, an outdoor location, a partner facility, or any other venue:

  • You acknowledge that physical training, speed work, strength training, and athletic activity carry inherent risks of injury including but not limited to muscle strains, sprains, fractures, concussions, heat-related illness, and other physical harm.
  • You knowingly, voluntarily, and freely assume all such risks, both known and unknown, related to your participation in RSP activities.
  • You confirm that the athlete is physically fit to participate and has no medical conditions that would prevent safe participation, or that such conditions have been fully disclosed to RSP in writing.
  • You agree to follow all safety instructions provided by RSP coaches and to immediately cease participation and notify a coach if you feel pain, dizziness, or any unusual physical symptoms.
  • For in-person training, parents or guardians of athletes under 18 are responsible for transportation to and from training sessions at all locations.

Waiver Requirement

All athletes (or their parent/legal guardian for minors under 18) must sign a liability waiver, assumption of risk agreement, and media release before participating in any in-person RSP activity. This applies to all training locations. Athletes without a signed, current waiver on file will not be permitted to participate.

4. Off-Site Training & Partner Facilities

RSP regularly conducts training at locations other than our primary facility, including public parks, school tracks, indoor sports complexes, partner gyms, and event venues. When participating in off-site RSP training:

  • RSP's Terms and Conditions, waiver requirements, and coaching standards apply at all locations where RSP operates, regardless of the venue.
  • Third-party facilities may have their own rules, waivers, and requirements. Athletes and parents are responsible for complying with both RSP's and the host facility's requirements.
  • RSP is not responsible for conditions, hazards, equipment, or actions of staff at third-party facilities that are outside RSP's direct control. RSP coaches will inspect training areas for obvious hazards before each session, but cannot guarantee the safety of facilities owned and operated by third parties.
  • If a session must be relocated due to weather, facility closure, or other circumstances, RSP will make reasonable efforts to notify athletes and parents via SMS, email, or the platform. Outdoor training may be canceled or modified due to weather conditions at the coach's discretion.

5. Subscriptions & Payments

  • Platform subscriptions and class packages are billed through Stripe and/or WellnessLiving.
  • In-person training packages, private sessions, camps, and evaluations are booked and paid through WellnessLiving or directly through RSP.
  • Subscription fees are charged at the beginning of each billing cycle (monthly or as specified at checkout).
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No pro-rated refunds are issued for partial months.
  • RSP reserves the right to change subscription and session pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.
  • Refund Policy: Refunds for unused private training sessions or package balances are handled on a case-by-case basis. Group class packages are non-refundable once the first session has been attended. Camp and combine fees are non-refundable within 48 hours of the event.   • No-Shows: Athletes who fail to attend a scheduled private session without 24-hour advance notice forfeit that session. Repeated no-shows may result in loss of remaining sessions in a package.

6. SMS / Text Message Communications

By providing your phone number and opting in to SMS notifications during registration or at any point, you consent to receive text messages from Run Speed Performance. These messages may include:

  • Training session reminders and confirmations
  • Personal record (PR) verification notifications
  • Coach notes and workout assignments
  • Camp, combine, and event reminders and updates
  • Recruiter access request notifications (parents)
  • Account and registration confirmations
  • Schedule changes, location changes, and cancellation notices

Frequency: Message frequency varies based on your training activity. Typically 2–10 messages per month.

Opt-Out: Reply STOP to any message to unsubscribe. Reply HELP for assistance. Reply START to re-subscribe.

Costs: Message and data rates may apply. RSP does not charge for SMS messages, but your carrier may.

Privacy: Your phone number is not shared with third parties for marketing purposes. SMS is delivered through Twilio. See our Privacy Policy for details.

7. Performance Data & Personal Records

  • Athletic performance data (PRs, workout logs, training history, combine results, assessments) entered on the RSP platform or recorded during in-person sessions is stored on our servers.
  • PRs submitted through the platform are subject to a verification process by RSP coaches. Only verified PRs appear on leaderboards.
  • By using the platform, you consent to your verified PRs being displayed on the RSP leaderboard, which may be visible to other registered users.
  • Training history is private by default. Third-party access (such as college recruiters) requires explicit parental approval through the Parent Portal.
  • RSP may use anonymized, aggregated performance data for research, marketing, or platform improvement purposes. Individual athletes will not be identifiable in aggregated data.

8. Recruiting Network

RSP operates a recruiting network connecting eligible athletes with college coaches. By participating:

  • Athletes age 14+ may be visible to registered college coaches on the Recruiter Dashboard. Basic profile information (name, graduation year, sport, school, verified PRs) may be displayed.
  • Full training history access requires a recruiter to submit a request, which the parent or guardian must explicitly approve or deny.
  • RSP does not guarantee any recruiting outcomes, scholarship offers, or college placements. RSP is not an agent, representative, or intermediary in the college recruiting process.
  • RSP provides a data platform; all recruiting decisions are made independently by coaches, athletes, and families.
  • Recruiters who misuse the platform, contact athletes inappropriately, or violate NCAA/NAIA/NJCAA rules may have their accounts suspended or terminated.

9. Photo, Video & Media Release

By participating in RSP training sessions, camps, combines, or events at any location, you grant RSP permission to photograph and record video of the athlete during training activities. This media may be used for:

  • Coaching analysis and performance review
  • RSP website, social media accounts, and marketing materials
  • Promotional content including advertisements, flyers, and presentations
  • Platform content including the Exercise Library, Video Vault, and training demonstrations

RSP will not publish a minor's full name alongside their image without explicit parental consent. Parents or athletes may opt out of promotional media use at any time by providing written notice to info@runspeedperform.com. Opting out does not affect the athlete's ability to train. Photos and videos used for internal coaching analysis are not subject to opt-out.

10. Coach Certification Program

RSP offers a coach certification program allowing qualified coaches to use RSP methodology and tools. Certified coaches:

  • Must complete all required training modules for their certification level.
  • Must maintain active certification through annual renewal.
  • Are independent contractors, not employees or agents of JJ Ultimate Sports Training LLC.
  • Are responsible for their own business operations, client relationships, insurance, and compliance with local laws.
  • Must carry their own general liability insurance coverage (minimum $1 million per occurrence) when conducting sessions independently of RSP, whether at their own facility, a partner location, a public park, or any other venue.
  • Must collect their own signed liability waivers, assumption of risk agreements, and medical disclosure forms from all athletes (or their parent/guardian for minors) before conducting any training session. RSP provides a waiver template, but certified coaches are responsible for ensuring waivers are signed and maintained for a minimum of 7 years.
  • Must verify that all minor athletes have parental or guardian consent before participation in any training session.
  • Are solely responsible for the safety and supervision of athletes during sessions they conduct independently. JJ Ultimate Sports Training LLC is not liable for injuries, incidents, or claims arising from sessions conducted by certified coaches outside of RSP-organized programs.
  • Must adhere to RSP's coaching standards and Code of Conduct. RSP may revoke certification for violations including unsafe practices, misconduct with athletes, failure to maintain insurance, failure to collect waivers, or misrepresentation of RSP affiliation.
  • May use RSP branding, materials, and platform tools only while certification is active. All RSP intellectual property remains the property of JJ Ultimate Sports Training LLC.

11. Code of Conduct

All athletes, parents, coaches, and users of the RSP platform and in-person programs are expected to:

  • Treat all athletes, coaches, staff, and fellow participants with respect and sportsmanship.
  • Follow all safety instructions from RSP coaches without exception.
  • Report any unsafe conditions, injuries, or concerning behavior to RSP staff immediately.
  • Refrain from bullying, harassment, discrimination, or abusive language directed at any person.
  • Not attend training while under the influence of drugs or alcohol.
  • Parents must not interfere with coaching during sessions. Feedback and concerns should be communicated to coaches before or after training.

RSP reserves the right to remove any individual from a session, event, or the platform for violations of this Code of Conduct without refund.

12. Intellectual Property

All content on the RSP platform and used in RSP programs — including training programs, exercise libraries, workout templates, coaching methodology, branding, logos, and proprietary materials — is the property of JJ Ultimate Sports Training LLC and is protected by copyright and trademark law. You may not copy, distribute, modify, reproduce, or create derivative works from RSP content without written permission.

13. Limitation of Liability

To the maximum extent permitted by Texas law:

  • JJ Ultimate Sports Training LLC, its owner, coaches, employees, certified trainers, and affiliates are not liable for any injuries sustained during training sessions, whether in-person or following digital workout programs, at any location where RSP operates.
  • RSP is not liable for injuries caused by conditions, equipment, or actions of staff at third-party facilities outside RSP's direct control.
  • RSP is not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform or participation in RSP programs.
  • RSP's total liability for any claim related to our services shall not exceed the amount you paid to RSP in the 12 months preceding the claim.
  • The platform is provided "as is" without warranties of any kind, express or implied.
  • Waivers and releases signed by participants or their parents/guardians are enforceable to the fullest extent permitted by Texas law. However, waivers do not protect against claims of gross negligence or intentional misconduct.

14. Indemnification

You agree to indemnify and hold harmless JJ Ultimate Sports Training LLC (DBA Run Speed Performance), its owner, coaches, employees, certified trainers, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the platform, participation in RSP programs, violation of these terms, or infringement of any third-party rights.

15. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these terms or your use of RSP services shall be resolved in the courts of Dallas County, Texas.

16. Business Transfer

In the event that JJ Ultimate Sports Training LLC is sold, merged, or transfers substantially all of its assets, these Terms and Conditions and your account information may be transferred to the successor entity. We will endeavor to require the successor to honor these terms. You will be notified of any ownership change via email or a prominent notice on our website.

17. Modifications

RSP reserves the right to modify these Terms and Conditions at any time. We will notify users of material changes by posting the updated terms on this page and updating the "Last Updated" date. Continued use of the platform or participation in RSP programs after changes are posted constitutes acceptance of the revised terms.
